Terms of Service

Plain-language terms for buying and using NightScape Lab. This is a prototype document. The final version may be revised before launch.

These Terms of Service ("Terms") govern your purchase and use of NightScape Lab ("the Software"), a Photoshop panel, an accompanying local processing engine, and a Lightroom Classic plugin. By buying, installing, or using the Software, you agree to these Terms. If you do not agree, do not install or use the Software.

1. Your license

NightScape Lab is sold as a one-time purchase. When you buy it, you own your copy. There is no subscription and no recurring fee. Your purchase grants you a personal, non-exclusive, non-transferable license to install and use the Software.

  • You may install and use the Software on the computers you personally own or control, for your own photography work.
  • You may use it for both personal and commercial photography. The images you make are yours.
  • The license is for you. Please don't share your purchase, license key, or installer with people outside your household or business.

2. What the license does not allow

  • Reselling, sublicensing, renting, or redistributing the Software or its installer.
  • Reverse-engineering, decompiling, or attempting to extract source code or bundled models, except where that restriction is prohibited by law.
  • Removing or altering copyright, trademark, or attribution notices.
  • Using the Software to build a competing product or to train a competing model.

3. Acceptable use

Use the Software lawfully and process only images you have the right to work with. You are responsible for your own files, your own backups, and the results you publish. The Software runs on your machine; you control what goes in and what comes out.

4. Updates and compatibility

The Software runs inside Adobe Photoshop 2023 (version 24.0) or newer on macOS and Windows, with optional Lightroom Classic integration. We may release updates that fix bugs, improve the tools, or maintain compatibility with new Photoshop versions. Updates within your purchased version are provided at our discretion and are typically included at no extra cost. Photoshop and Lightroom Classic are separate products from Adobe, with their own terms and requirements that are not covered here. A future major version of NightScape Lab may be offered as a separate paid upgrade.

5. No warranty

The Software is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be error-free, uninterrupted, or that it will meet every expectation. Astrophotography results depend on your source frames, your camera, and your shooting conditions.

6. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, images, or profits arising from your use of or inability to use the Software. Where liability cannot be excluded, it is limited to the amount you paid for the Software. Always keep backups of your original RAW files and works in progress.

7. Refunds

Because there is no subscription and no free trial, the demonstrations, before/after images, and comparison material on this site serve as your test drive. On top of that, every purchase is covered by a 30-day money-back guarantee: if NightScape Lab is not right for you, email within 30 days of your purchase and we will refund your payment in full, no questions asked.

8. Changes to these Terms

We may update these Terms as the product evolves. Material changes will be reflected by updating the "Last updated" date above. Continued use after a change means you accept the revised Terms.

9. Governing law

These Terms are governed by the laws of the jurisdiction in which the Software's publisher is established, without regard to conflict-of-law rules. [Governing-law and venue placeholder: to be finalized before launch.]
